§ 12.06.01. Flora and fauna.

  • Plant and animal (flora and fauna) species designated and listed by the state or federal governments as endangered or threatened shall not be disturbed and all applications for development activity with the potential to adversely affect such species shall be provided to the appropriate regulatory agencies prior to final approval by the town. If the regulatory agencies determine that disturbing such species can be allowed under specified conditions, those conditions shall become part of the development approval.

    Areas known to be important to animal species designated as endangered or threatened by the state or federal governments for reproduction, feeding or nesting of such species shall not be altered or in anyway affected by development without the approval of the Town and the regulatory agencies.
