§ 7.07.01. Activities permitted as a special exception:

The following activities may be permitted by the town council as special exceptions in the C-1 and C-2 and MU districts:

1.

Outdoor merchandise display.

2.

Outdoor dining.

Child care centers, nursery schools and kindergartens in which more than five children are present at any given time shall have a minimum floor space (apart from administrative or residential use) of 35 square feet per child. Each child must also have a minimum on 100 square feet of outside play area enclosed by a minimum of six feet high chain link fence. All licensed child care facilities must provide a separate kitchen and separate bathrooms apart from the normal living quarters in accordance with state law and life safety codes.

Any proposed structure exceeding 45 feet in height.
