§ 7.07.02. Conditional uses.

  • Conditional uses referenced in the regulations for each zoning district wherein conditional uses are allowed may be approved pursuant to the following procedures:

    1.

    There shall be at least one public hearing before the town council advertised in the legal section of a newspaper of general circulation in the town at least ten days prior to the hearing.

    2.

    The costs of the advertisement shall be the responsibility of the applicant and the costs shall be paid to the town prior to the hearing. Failure to timely pay the costs shall cause the request to be denied.

    3.

    All requirements for a conditional use included in this Code, or any additional requirements imposed by the town council due to special conditions or circumstances unique to the property or the use requested, shall be followed. Failure to continuously abide by the regulations shall constitute a violation of this Code and may result in fines, damages and the cessation of the conditional use.
